Before using our platform, please read these Terms of Use carefully. By accessing or using the WaterStart app, you agree to be bound by these terms. If you do not agree to these terms, please do not use our platform.
• 1. User and Partner Safety
1.1. Responsibility: Partners (instructors, schools, and service providers listed on this platform) are entirely responsible for the safety of users during water sports activities or any other service that they may offer on the platform. Partners are solely responsible for compliance with all local, regional, and national legal requirements for offering their services and the platform is in no way liable for the Partners compromise in safety standards or their commercial conduct.
1.2. Service Quality: Partners are required to maintain high standards of service to keep their services listed on the platform. Users have the right to review and rate their experience with partners, ensuring that the platform only offers reliable and quality partners for the end users.
1.3. Prohibited ActivitiesYou agree not to engage in any of the following prohibited activities while using our Site and Services:
• Use our Site or Services for any unlawful purpose.
• Attempt to gain unauthorized access to our Site or Services.
• Use our Site or Services to engage in any form of harassmentor threatening behavior.
• Use our Site or Services to transmit viruses, worms, or other harmful code.
• Impersonate any person or entity.• Violate any applicable laws or regulations.
• 2. Payment Processing
2.1. Payment Modality: Partners must adhere to the payment processing method and engine adopted on the WaterStart platform. No other payment method shall be used so settle transactions between a partner and an user of the platform.
2.2. Payment Release: Payment from the client will only be processed to the partner after the client confirms the conclusion of the services.
2.3. Dispute Resolution: In case of disagreements regarding services provided or their completion, the platform moderators will analyze each case individually and make decisions considering both parties' perspectives.2.4 - Both parties (Users and Partners) recognize that the decision of the administrator of this platform as ultimate and final.3. Commission Fees3.1. Commission Rate: WaterStart charges a commission fee of 10% of the total value for services sold through the platform and 5% for the sale of goods. These rates might be subject to change in the future, and partners will be notified of any rate adjustments.
4. Participation Privilege
4.1. Privilege, Not a Right: Being a partner or user on the WaterStart platform is a privilege, not a right. Participation may be subject to refusal at the discretion of the platform administrators.5. Proof of Fiscal Residence
5.1. Document Submission: Partners must provide proof of fiscal residence documents to receive payment. This ensures compliance with relevant tax regulations.6. Data Protection6.1. Data Privacy: WaterStart complies with all applicable data protection laws, including the latest laws in the EU. We collect, use, and protect user data as described in our Privacy Policy.7. Changes to Terms7.1. Updates: WaterStart reserves the right to update, change, or replace any part of these Terms of Use at our sole discretion. Changes will be effective immediately upon posting on the platform. It is your responsibility to check these terms regularly for updates.8. Governing Law and Jurisdiction8.1.
